Family Law

One of the most emotionally trying times in anyone’s life is facing the complexities and uncertainties of a domestic dispute. The most important thing in a divorce is making sure that you receive your fair share of that which you put into the relationship. Issues of child custody, child support, maintenance (alimony), disposition of marital property and disposition of marital debt are matters that must be addressed in a thorough manner since the decisions and determinations that you make at this juncture will affect the rest of your life and the lives of your children.

Aggressive and effective legal representation is a must. From the initiation of the proceedings and the filing of the petition, be it divorce, paternity or motion to modify, through negotiations and ultimate trial before a Circuit Court Judge, the individual going through this process needs to make sure that they have a legal representative who is both comfortable and formidable in negotiations and, if necessary, in trial if the case cannot be settled between the parties.

It is important to engage a firm that will keep the client informed of all developments and assist the client through sound legal advice to make the right decisions for themselves and for their family. Additionally, years after the initial domestic dispute has been resolved, circumstances in the lives of the divorced parties may change causing the need for a reevaluation of the terms of the decree regarding child support, child custody and/or maintenance.

Individuals may also find that they are in the situation where there was no marriage but from a relationship a child was born. In these cases, without a paternity order, the father has no legal right to custody with the child. The mother, without such an order has no legal ability to require the father to pay child support.
